संवैधानिक विकास, 1857 ई. की क्रांति के पश्चात् भारत का शासन ईस्ट इंडिया कम्पनी के स्थान पर ब्रिटिश सम्राट के हाथ में चला गया और भारत की जनता ब्रिटिश साम्राज्ञी महारानी विक्टोरिया की प्रजा हो गई। भारत के गवर्नर जनरल की उपाधि ‘वायसराय’ (अर्थात् ब्रिटिश साम्राज्ञी का प्रतिनिधि) हो गई। भारत की स्वतंत्रता प्राप्ति के समय अर्थात् 15 अगस्त, 1947 ई. तक भारतीय सत्ता ब्रिटिश शासन के ही अधीन रही और इसी से भारत को स्वतंत्रता प्राप्त हुई। 1857 ई. के पश्चात् जब भारत का शासन ब्रिटिश साम्राज्ञी के अधीन आया, तभी से भारत संवैधानिक विकास का पथ प्रशस्त हुआ।

1858 ई. का भारत सरकार अधिनियम
• इस अधिनियम को ‘1858 ऐक्ट फॉर दी बेटर गवर्नमेण्ट ऑफ इंडिया’ कहा जाता है।
• इस अधिनियम ने भारत के शासन को कम्पनी के हाथों से निकालकर ब्रिटिश साम्राज्ञी को सौंप दिया।
• इस अधिनियम द्वारा भारत का प्रशासन, ब्रिटिश साम्राज्ञी द्वारा नियुक्त 15 सदस्यीय एक परिषद् को सौंप दिया गया, जिसका अध्यक्ष मुख्य राज्य सचिव (भारत राज्य सचिव के नाम से विभूषित) बनाया गया।
• इस अधिनियम के द्वारा भारत के गवर्नर जनरल को ‘वायसराय’ की उपाधि दी गई, वह क्राउन का सीधा प्रतिनिधि कहलाता था।
• इस अधिनियम के द्वारा राज्य सचिव को एक ‘विकास निगम’ घोषित किया गया, राज्य सचिव ब्रिटिश मन्त्रिमण्डल का सदस्य होता था, इसलिए वह ब्रिटिश संसद के प्रति उत्तरदायी था।
1861 ई. का भारतीय परिषद् अधिनियम
• 1861 ई. में भारतीय प्रशासन में सुधार के लिए एक अधिनियम पारित किया गया, जिसे 1861 ई. का भारतीय परिषद् अधिनियम कहा जाता है।
• इस अधिनियम द्वारा केन्द्रीय विधानपरिषद् की सदस्य संख्या में वृद्धि की गई थी।
• इस अधिनियम द्वारा प्रान्तीय विधान परिषदों की स्थापना की गई, किन्तु यहां पारित कानूनों पर गवर्नर-जनरल (वायसराय) की स्वीकृति अनिवार्य थी।
• इस अधिनियम के द्वारा गवर्नर जनरल (वायसराय) की कार्यकारिणी में विभाग (Partfolio) पद्धति को लागू कर दिया गया।
• इस अधिनियम द्वारा वायसराय की कार्यकारी परिषद् में एक पांचवां सदस्य सम्मिलित किया गया, जोकि एक विधिवेत्ता का पद था।
• इस अधिनियम द्वारा वायसराय की परिषद् को कानून बनाने की शक्ति प्रदान की गई, जिसके अंतर्गत लॉर्ड कैनिंग ने विभागीय प्रणाली का सूत्रपात किया। इसी से मन्त्रिमण्डलीय व्यवस्था का जन्म हुआ क्योंकि लॉर्ड कैनिंग ने भिन्न-भिन्न सदस्यों को पृथक-पृथक विभाग सौंप रखे थे।
• इस अधिनियम के द्वारा वायसराय की केन्द्रीय विधान परिषद् की संख्या न्यूनतम 6 तथा अधिकतम 12 निर्धारित हुई। इन सदस्यों की अवधि दो वर्ष निर्धारित हुई थी तथा इन्हें वायसराय मनोनीत करता था। इन मनोनीत सदस्यों में से आधे सदस्य गैर-सरकारी सदस्य होते थे।
1892 ई. का भारतीय परिषद् अधिनियम
• इस अधिनियम द्वारा केन्द्रीय तथा प्रान्तीय विधान परिषदों की सदस्य संख्या में वृद्धि की गई थी। केन्द्रीय विधान परिषद् में न्यूनतम 10 तथा अधिकतम 16 सदस्यों की संख्या निर्धारित की गई थी।
• इस अधिनियम द्वारा विधान परिषदों के सदस्यों को वार्षिक बजट पर बहस करने तथा सरकार से प्रश्न पूछने का अधिकार दिया गया।
• इस अधिनियम द्वारा प्रान्तीय विधानमण्डलों को न्यूनतम 8 तथा अधिकतम 29 अतिरिक्त सदस्यों द्वारा बढ़ा दिया गया था।
• इस अधिनियम का सर्वाधिक महत्वपूर्ण प्रावधान चुनाव पद्धति का सूत्रपात होना था।
1909 ई. का भारतीय परिषद् अधिनियम
• इस अधिनियम को ‘मॉर्ले-मिन्टो सुधार अधिनियम’ भी कहा जाता है। क्योंकि इसके पारित होने के समय भारत के वायसराय लार्ड मिन्टो तथा भारत सचिव लार्ड मार्ले थे।
• इस अधिनियम के द्वारा विधान परिषदों के सदस्यों की संख्या में वृद्धि की गई थी तथा भारतीयों को पहली बार प्रतिनिधित्व प्रदान किया गया था। इस दृष्टिकोण से इस अधिनियम द्वारा प्रजातांत्रिक सिद्धान्तों का विकास हुआ।
• इस अधिनियम द्वारा प्रान्तीय विधान परिषदों के सदस्यों का निर्वाचन सम्प्रदाय के आधार पर निर्धारित किया गया।
• इस अधिनियम के द्वारा प्रान्तीय विधान परिषदों को बहस करने एवं पूरक प्रश्न पूछने का अधिकार प्रदान किया गया।
• इस अधिनियम के द्वारा प्रान्तीय विधान परिषदें केवल सार्वजनिक मामलों पर बहस कर सकती थीं, सैनिक व विदेशी मामलों पर नहीं।
• इस अधिनियम के द्वारा प्रान्तों में भी कार्यकारी समिति का निर्माण किया जा सकता था, किन्तु यह वायसराय की इच्छा पर निर्भर था।
• इस अधिनियम द्वारा प्रान्तीय विधान परिषदों में मुसलमानों को अपने प्रतिनिधि अलग से चुनने का अधिकार था।
1919 ई. का भारत सरकार अधिनियम
• इस अधिनियम को ‘माण्टेग्यू-चेम्सफोर्ड’ सुधार भी कहा जाता है। क्योंकि इस काल में भारत सचिव माण्टेग्यू तथा वायसराय लॉर्ड चेम्सफोर्ड थे।
• इस अधिनियम के अंतर्गत भारत सचिव व इंग्लैण्ड की संसद द्वारा भारतीय शासन पर नियंत्रण में कमी की गयी।
• इस अधिनियम के द्वारा भारत सचिव के कार्यालय का खर्चा ब्रिटिश राजस्व से लिया जाना तय किया गया, जबकि इससे पहले यह खर्चा भारतीय राजस्व से लिया जाता था।
• इस अधिनियम के द्वारा इंग्लैण्ड में भारत सरकार के प्रतिनिधि के रूप में एक नवीन पद का सृजन किया गया, इस नए पदाधिकारी को ‘भारतीय उच्चायुक्त’ कहा गया।
• इस अधिनियम के द्वारा गवर्नर जनरल एवं गवर्नरों के अधिकारों में वृद्धि की गई, जिनका उपयोग वे स्वेच्छा से कर सकते थे।
• इस अधिनियम में, भारतीयों की यह मांग कि साम्प्रदायिक चुनाव पद्धति को समाप्त कर दिया जाए, को स्वीकार नहीं किया गया। इसके विपरीत इस प्रणाली को और बढ़ावा दिया गया।
• इस अधिनियम द्वारा गवर्नर जनरल की कार्यकारी परिषद् में भारतीय सदस्यों की संख्या को बढ़ाया गया।
• इस अधिनियम द्वारा एक सदन वाले केन्द्रीय विधान मण्डल का पुनर्संगठन किया गया। अब दो सदन वाले विधान मण्डल की व्यवस्था की गई। उच्च सदन को ‘राज्य परिषद्’ तथा निचले सदन को ‘केन्द्रीय विधान सभा’ कहा गया।
• इस अधिनियम द्वारा प्रत्यक्ष चुनाव पद्धति को लागू किया गया।
• इस अधिनियम के द्वारा एक महत्वपूर्ण कार्य प्रान्तों में द्वैध शासन प्रणाली को लागू किया जाना था। इस व्यवस्था के अंतर्गत प्रान्तीय विषयों को दो भागों में बाँटा गया- ‘संरक्षित विषय’ तथा ‘हस्तान्तरित विषय’। संरक्षित विषयों को गवर्नर की कार्यकारी परिषद् के अधीन किया गया और हस्तान्तरित विषयों को विधानसभाओं के मंत्रियों के अधीन किया गया।
• इस अधिनियम के द्वारा एक लोक सेवा आयोग की स्थापना की गई। भारत सचिव को इस आयोग की नियुक्ति का कार्य सौंपा गया।
• इस अधिनियम के लागू किए जाने के 10 वर्षों के अंदर ही एक आयोग की नियुक्ति की जानी थी, जिसका कार्य इस अधिनियम के प्रति प्रतिक्रियाओं की रिपोर्ट इंग्लैण्ड की संसद को देना था।
1935 ई. का भारत सरकार अधिनियम
• ब्रिटिश सरकार ने मार्च 1933 ई. में भारतीय संवैधानिक सुधार से सम्बन्धित एक श्वेत पत्र प्रकाशित किया। जिस पर विचार विमर्श करने के लिये लार्ड लिनलिथगो की अध्यक्षता में ब्रिटिश संसद की एक संयुक्त समिति स्थापित की गई।
• ब्रिटिश संसद की संयुक्त समिति के आधार पर ‘सर सैमुअल होर’ द्वारा 19 दिसंबर, 1934 ई. को भारत शासन विधेयक ब्रिटिश संसद में प्रस्तुत किया गया, जिसे ब्रिटिश संसद ने बहुमत से पारित कर दिया। 3 अगस्त, 1935 को ब्रिटिश सम्राट ने इस विधेयक को अपनी सम्मति प्रदान की, यही विधेयक 1935 ई. का भारत सरकार अधिनियम के नाम से प्रसिद्ध हुआ।
• इस अधिनियम द्वारा सर्वप्रथम भारत में संघात्मक सरकार की स्थापना की गई थी तथा प्रान्तों में द्वैध शासन समाप्त करके केन्द्र में द्वैध शासन स्थापित किया गया था।
• इस अधिनियम द्वारा प्रान्तों को स्वायत्तता प्रदान की गई थी।
• इस अधिनियम द्वारा प्रान्तीय विषयों पर कानून बनाने का अधिकार प्रान्तों को प्रदान किया गया था।
• इस अधिनियम द्वारा प्रान्तों की कार्यपालिका शक्ति गवर्नर में निहित घोषित की गई।
• इस अधिनियम के द्वारा केन्द्र में स्थापित द्वैध शासन के अंतर्गत केन्द्रीय विधानमण्डल को दो सदनों में विभाजित किया गया-विधानसभा और राज्यपरिषद् । विधानसभा में 375 सदस्य (250 ब्रिटिश प्रान्तों से एवं 125 भारतीय रियासतों से) होते थे। इसका कार्यकाल 5 वर्ष होता था। विधानसभा को विघटित करने की शक्ति गवर्नर जनरल में निहित थी। राज्य परिषद् में 260 सदस्य (156 ब्रिटिश भारत के प्रतिनिधि एवं 104 भारतीय रियासतों के प्रतिनिधि) होते थे। यह स्थाई सदन था, जिसके एक-तिहाई सदस्य प्रति दूसरे वर्ष अवकाश ग्रहण करते थे।
• इस अधिनियम द्वारा बर्मा को ब्रिटिश भारत से पृथक कर दिया गया था तथा दो नए प्रान्त (सिन्ध एवं उड़ीसा) गठित हुए थे।
• इस अधिनियम के अंतर्गत संघ की इकाइयों के आपसी विवाद आदि निपटाने के एक संघीय न्यायालय की स्थापना की गई, यद्यपि यह सर्वोच्च न्यायालय नहीं था। सर्वोच्च न्यायालय प्रिवी कौंसिल था।
• इस अधिनियम द्वारा मतदाताओं के लिए आवश्यक अर्हताओं में कमी की गई।
• इस अधिनियम के द्वारा प्रान्तों में प्रत्यक्ष चुनाव पद्धति लागू की गई।
1947 ई. का भारतीय स्वतंत्रता अधिनियम
• 4 जुलाई, 1947 ई. को इंग्लैण्ड की संसद द्वारा ‘भारतीय स्वतंत्रता अधिनियम’ पारित किया गया, 16 जुलाई, 1947 ई. को लार्ड सभा ने इसे पारित किया तथा 18 जुलाई, 1947 ई. को ब्रिटिश सम्राट ने इस अधिनियम पर अपने हस्ताक्षर किए।
• इस अधिनियम की प्रमुखख धाराएं निम्नांकित थी :
• 15 अगस्त, 1947 ई. को भारत दो अधिराज्यों-भारत एवं पाकिस्तान में विभाजित कर दिया जाएगा। सिन्ध, उत्तर-पूर्वी, सीमा प्रान्त, पश्चिमी पंजाब, बलूचिस्तान तथा असम का सिलहट जिला पाकिस्तान में तथा शेष भारत में रहेगा।
• दोनों अधिराज्यों की विधानसभाओं को अपने-अपने संविधान बनाने का अधिकार दिया गया।
• नवीन संविधानों के निर्माण तक शासन 1935 ई. के अधिनियम के अनुसार चलता रहेगा।
• 15 अगस्त, 1947 ई. से भारत सचिव एवं इंडिया ऑफिस को समाप्त कर दिया जायेगा।
• 15 अगस्त, 1947 ई. से ब्रिटिश सरकार का दोनों अधिराज्यों पर कोई नियंत्रण नहीं रहेगा।
• भारतीय रियासतों को भारत अथवा पाकिस्तान किसी भी देश में सम्मिलित होने का अधिकार दिया गया।
• इस अधिनियम के द्वारा भारत अंतत: 15 अगस्त, 1947 ई. को ब्रिटिश दासता से मुक्त हुआ।
